These Terms of Service ("Terms") govern your use of the Pheno mobile application ("App"), operated by Cultivar Labs LLC, a Wyoming limited liability company ("we", "us", or "our"). By downloading or using Pheno, you agree to these Terms.
You must be at least 18 years of age to use Pheno. By using the App, you represent that you are 18 or older. You are solely responsible for ensuring your use of the App complies with all applicable local, state, and federal laws in your jurisdiction.
Pheno is a mobile software application for plant cultivation tracking, logging, and management. The App provides tools including grow journals, AI-assisted advice, environmental tracking, harvest planning, and related features. Pheno is intended for personal, lawful use only.
You may use Pheno as a guest or by creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Pheno Pro is a paid subscription service available on a weekly, monthly, or annual basis. Subscriptions are processed through Apple App Store or Google Play Store. The following terms apply:

Pheno's AI features (Crop Doctor, Trichome AI, Chat, Weekly Summary) provide informational content only. AI-generated advice is not a substitute for professional agricultural, medical, or legal advice. We make no guarantee regarding the accuracy, completeness, or suitability of AI-generated content for your specific situation. You use AI features at your own risk.
Pheno, the Pheno logo, and all content, features, and functionality of the App are owned by Cultivar Labs LLC and are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without our prior written consent.
You retain ownership of any content you create and upload (grow logs, photos, notes). By uploading content, you grant us a limited license to store and display that content solely for the purpose of operating the App for you.
The Pheno Shop contains affiliate links to third-party products on Amazon. We earn a small commission on qualifying purchases at no additional cost to you. We are not responsible for the content, pricing, or availability of third-party products. Purchases made through affiliate links are subject to Amazon's terms and policies.
Pheno is provided "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be error-free, uninterrupted, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, Cultivar Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use Pheno, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Cultivar Labs LLC and its members, officers, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any applicable law.
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us at support@growpheno.com. Upon termination, your right to use the App ceases immediately.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Wyoming.
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use of Pheno after changes constitutes acceptance of the updated Terms.
